1 Southbourne Way, Porton, Wiltshire SP4 0NN
• The appeal is made under section 78 of the Town and Country Planning Act 1990
against a refusal to grant planning permission.
• The appeal is made by Steven Bryant against the decision of Wiltshire Council.
• The application Ref 19/08230/FUL, dated 27 August 2019, was refused by notice
stated as being dated 14 January 2020.
• The development proposed is erection of close-board wooden fence around side
and part of front of property.
Decision
1. The appeal is allowed and planning permission is granted for erection of close-
board wooden fence around side and part of front of property at 1 Southbourne
Way, Porton, Wiltshire SP4 0NN in accordance with the terms of the
application, Ref 19/08230/FUL, dated 27 August 2019 and the submitted plans.
Preliminary Matter
2. The development subject of this appeal has been carried out. I have had regard
to the fence on the site as well as the details shown on the appeal documents.
Main Issue
3. The main issue is the effect on the character and appearance of the area.
Reasons
4. A mix of roadside boundary features can be seen close to the appeal property
including fencing on Southbourne Way and on the corner of Tidworth Road and
Winterslow Road. While it is conspicuous, the appeal development is generally
in keeping with these other nearby fences in terms of its height, design and
colour. Consequently, it is not incongruous but is sympathetic to its context.
5. As such, I conclude the development does not harm the character and
appearance of the area. In this regard, it accords with core policy 57 of the
Wiltshire Core Strategy 2015 and the Creating Place Design Guide 2006. These
aim to ensure development responds positively to the existing townscape.
6. Therefore, I conclude the appeal should be allowed. The fence has been
completed and so there is no need for the conditions suggested by the Council.
