Breach of planning control as alleged in the notice is, on 12th May 1997, planning permission was granted for replacement of the original timber framed sash windows and a small number of existing casement windows with timber framed, double-glazed replacements (97/00179/FUL). The permission was implemented and the permitted windows remained in place until their removal in May 2014. Condition 3 of the 1997 permission is as follows:
